​These Terms and Conditions (“Agreement”) govern your participation in our Membership Program (“Program”). By enrolling, you (“Member”) agree to be bound by this Agreement. Please read carefully.

1. Membership Benefits

 

1.1 Scope of Benefits: The Program provides Members with exclusive benefits, including but not limited to discounted services, priority scheduling, complimentary treatments, and/or access to special promotions, as outlined.

1.2 Non-Transferable: Benefits are exclusive to the Member and may not be transferred, shared, or assigned to others unless expressly permitted in writing by Georgia Aesthetics.

1.3 Service Availability: Benefits are subject to availability and may be modified at Georgia Aesthetics' discretion. Specific clinicians, appointment times, or treatment outcomes are not guaranteed.

2. Payment Terms

​

2.1 Membership Fees: Members agree to pay the recurring membership fee specified plus applicable taxes or surcharges, via automatic payment.

2.2 Payment Schedule: Fees are charged monthly on date selected at enrollment.

2.3 Payment Updates: Members must maintain current payment information. Failure to update payment details within thirty (30) days of a failed payment may result in membership suspension or termination.

2.4 Non-Refundable Fees: Except as provided in Section 4, membership fees are non-refundable.

3. Membership Term and Termination

3.1 Minimum Commitment: The Program requires a minimum commitment of 6 months, unless otherwise specified at enrollment.

3.2 Member Cancellation: Members may cancel with thirty (30) days written notice to Georgia Aesthetics. Early cancellation within the minimum commitment period may incur a termination fee of $149 or the prorated cost of services used at standard rates, whichever is greater.

3.3 Valid Cancellation Reasons: Cancellation without penalty is permitted for:

• Relocation beyond 35 miles from Georgia Aesthetics, with proof of new address.

• Medical inability to receive treatments, with a physician’s note.

• Permanent closure of Georgia Aesthetics.

3.4 Spa Termination: Georgia Aesthetics may terminate a membership for reasons including, but not limited to, non-payment, providing false information, or violation of spa policies. Terminated Members will be notified in writing and forfeit unused benefits.

4. Refunds and Membership Freeze

 

4.1 Refunds: Refunds for unused services may be issued at Georgia Aesthetics'' discretion, prorated at standard rates, within thirty (30) days of cancellation. Membership fees are non-refundable unless required by law.

4.2 Membership Freeze: Members may request to freeze their membership for medical reasons, extended travel, or pregnancy, subject to approval. Freeze periods preserve benefits without cancellation, with a maximum duration of 3 months per calendar year.

4.3 Service Rollover: Unused services or credits may roll over. Non-rollable benefits expire at the end of the billing cycle.

5. Member Responsibilities

 

5.1 Appointments: Members must schedule appointments in advance and comply with Georgia Aesthetics' cancellation policy to avoid fees.

5.2 Health Information: Members must promptly notify Georgia Aesthetics of changes in health, skin conditions, or contact information to ensure safe and effective treatments. 5.3 Consent Forms: Members must sign treatment consent forms acknowledging risks and confirming eligibility for services.

6. Liability and Waivers

​

6.1 Assumption of Risk: Members acknowledge that spa treatments carry inherent risks, including but not limited to allergic reactions, skin irritation, or injury. Members assume these risks and waive claims against Georgia Aesthetics, its employees, or affiliates for damages, except where prohibited by law.

6.2 Indemnification: Members agree to indemnify Georgia Aesthetics against claims arising from their use of services or violation of this Agreement.

7. Compliance with Laws

 

7.1 Regulatory Compliance: This Agreement complies with applicable laws, including the Health Insurance Portability and Accountability Act (HIPAA) for protecting Member data.

7.2 No Insurance: The Program is not a health insurance plan and is not reimbursable by Medicare, Medicaid, or private insurers.

7.3 Age Requirement: Members must be at least 18 years of age to enroll.

8. Modifications to Terms

8.1 Changes to Agreement: Georgia Aesthetics reserves the right to modify this Agreement, membership fees, or Program benefits at its discretion, with or without notice, unless otherwise required by law.

8.2 Notice of Changes: Significant changes will be communicated via email or posted at Georgia Aesthetics' facility. Continued participation constitutes acceptance of modified terms.

9. General Provisions

​

9.1 Governing Law: This Agreement is governed by the laws of the state of Georgia, without regard to conflict of law principles.

9.2 Dispute Resolution: Disputes arising from this Agreement will be resolved through mediation in Bartow County, Georgia, as permitted by law.

9.3 Severability: If any provision is deemed invalid, the remaining provisions remain in effect.

9.4 Entire Agreement: This Agreement constitutes the entire understanding between Member and Georgia Aesthetics, superseding prior agreements or representations.
